Scheduling
Either attorney (or either party, if unrepresented by counsel) contacts Kim@prochnaudisputeresolution.com to obtain available dates and times. The sessions start at a time agreed upon by the parties, as early as 8 a.m. and as late as 5 p.m., depending on when the matter is settled or the parties and continue until the matter is settled or the parties agree to terminate the session.
When contacting Prochnau Dispute Resolution Services, please be sure to indicate whether you are seeking mediation or arbitration and how many parties are involved. Once the date and time are agreed upon, a confirmation email is sent to all attorneys and unrepresented parties which confirms the date and time for the meeting. The Confirmation email will also include the date by which written submissions are to be exchanged and payment of the deposit required to secure the date and time. Amenities

Fees for Mediation, Arbitration and Discovery Master Services
The agreement to render services is between Prochnau Dispute Resolution (PDR) and the attorney of each of the participating parties. Attorneys are responsible for payment of their clients’ share of mediation costs by the date due and are advised to pre-collect the projected fees prior to the session date. (Pro Se Litigants will be expected to pay their share of the estimated mediation costs in advance.) PDR is not responsible for obtaining payment from the clients of attorney. Written confirmation of the fee allocation and commitment to pay must be received prior to the final confirmation of scheduled time.
Judge Prochnau charges $275 per hour for Mediation and Discovery Master Services and $300 an hour for Arbitration Services. The fees include time for reviewing the written submissions by each party in advance of the session. If the parties choose to extend the mediation session beyond the scheduled time, they are expected to pay for the additional hours at the time of the session, either by credit or debit card or transfer from a bank account. If the advanced payment is not sufficient to pay for the time incurred by Judge Prochnau to arbitrate the issues, the additional payment will be due prior to the Arbitration Decision being released. If the mediation results in a settlement, Judge Prochnau will allot one hour free of charge at a later time to help resolve any drafting issues via email or phone. If the parties are unable to fully resolve the issues following a full day or more of mediation, Judge Prochnau will allot two hours of time free of charge to assist in settling the issues via phone or email. We assume that each party will be responsible for an equal share of the fees, unless otherwise advised. Advance Payment for the sessions can be made by check, debit or credit card (Visa, Master Card, Discover, or American Express) or electronic transfer into the Prochnau Dispute Resolution bank account. Any additional payment due at the time of the session can be made by debit or credit card or a check drawn on an attorneys bank account. CANCELLATION OR RESCHEDULING-There is ordinarily no refund for the first five hours reserved, if the hours are not fully expended or if the session is cancelled for any reason. If the session is rescheduled at least ten days in advance of the session, the deposit will be applied to the new session date; if rescheduled less than ten days, the deposit will be applied to the new session date, less a $500 cancellation fee. |
Special Circumstances: Be sure to tell us of any no-contact or protection orders in place. (You may need to ask the court to modify the order to allow the parties to be at our office together--although we will provide for separate rooms.)
